Eight Seattle residents have filed suit with the help of the conservative Pacific Legal Foundation against probes of their garbage containers. Seattle liberals have been pushing for several years to conduct searches of garbage, going back to Mayor Greg Nickels, who was last in office in 2010. The idea is to search peoples' garbage to see if they are recycling properly, and slap a fine on them if not.
The Fourth Amendment to the US Constitution states.

your garbage is no longer yours once you put it in a city owned container for disposal. The 4th amendment doesnt seem to apply.
That being said, I find the idea of doing so offensive. Total.....wait for it.......garbage.
The city cannot argue that though. If they use the abandonment argument used in previous fourth amendment cases involving trash, then they cannot at the same time argue that the trash belongs to the resident and therefore the resident can be fined for not composting "their" trash.

They are using it for evidence of prior behavior. You cant say "hey the resident no longer owned the blood covered knife! Thus you cant charge him!" Thats nonsense.
Again, I feel I should reiterate, I find the city going through my trash for this sort of thing offensive. I'm just saying that the 4th amendment doesn't apply.

How can "inspectors" prove that it was indeed you that improperly disposed of garbage? Once it's on the street, can't anyone just open up the lid and dump **** in there?
Who's trash does become once it is picked up by the garbage men ?
If it is the property of the city then they are responsible for it, not the depositor.

Republicans never saw statewide office in the South between Reconstruction and the late 1970s. Gulf drilling was begun and continued through the time that Democrats controlled the region.
If you doubt they were leftists, Democratic rule there was solidified during WPA.
If I lived in Seattle I would save my dogs crap for the week and place it on the top of the trash with a note that says "your welcome"
