It's pretty broad. It would include, for instance, throwing down your weapon and running the other way or hunkering down behind cover and failing to go forward. Because it's so broad, the possible penalties are also broad. At the very worse, in can include death...or simple discharge. Since he supported Islamic enemies, and since American lives were lost as a result...I have to expect that he will receive a presidential pardon.

Irrelevant. He went to Pakistan later. At the time we went into Afghanistan he was in Afghanistan. And the Taliban sheltered and protected UBL. They opened fire on US forces just as eagerly as AQ fighters. Therefore they get the horn.

They opened fire on US forces because US forces were infidel, uninvited armed forces in their country.
