New law lets cops confiscate guns without notice

So any SANE people left in California care to chime in? You do realize this is going to be used to confiscate conservative, libertarian, constitutionalist, etc guns...it will be used by angry ex spouses or lovers or just pissed off co workers to go claim you are angry or mentally ill and POOF there go your weapons you LEGALLY own and bought. This will ALSO force more gun sales to be private and unregistered which will in turn hurt gun stores. The overwhelming stupidity of California politicians is simply amazing. They are leading the country in showing the kind of liberal tyrannical government they want enforced on ALL of America.

Reading the bill rather than your link, it actually makes a lot of sense....not that I expect you to read the actual bill....

Quote:
This bill would authorize a court to issue a temporary emergency gun violence restraining order if a law enforcement officer asserts and a judicial officer finds that there is reasonable cause to believe that the subject of the petition poses an immediate and present danger of causing personal injury to himself, herself, or another by having in his or her custody or control, owning, purchasing, possessing, or receiving a firearm and that the order is necessary to prevent personal injury to himself, herself, or another, as specified. The bill would require a law enforcement officer to serve the order on the restrained person, if the restrained person can reasonably be located, file a copy of the order with the court, and have the order entered into the computer database system for protective and restraining orders maintained by the Department of Justice.

as with any law, there is potential for abuse. however it is a reasonable law to help prevent gun violence by someone who isnt thinking right. will it stop such violence? no it wont. can it be abused by people and law enforcement? yes. but it does require due process before such a restraining order can be issued, and that gives the person in question a chance to defend themselves in open court.

lets see how it works out before we condemn or support the law.

The law you and the article describe is not a good one (not Draconian in anyway, but not a good one all the same). However, it's also not the whole story. The confiscation cannot just be done on a whim. There essentially needs to be probably cause; the amount of evidence that is needed just to issue a warrant. And the confiscation is temporary, unless reason to extend it is found, which would basically mean something serious enough to result in a criminal charge.

An article will never give you all the information you need. This one did give a link to it though, a link you obviously didn't click as the second paragraph of the bill disproves the notion that the gun can just be taken without reason.

It infringes on 2nd amendment therefore its unconstitutional but I don't expect any judge in California to declare it so.

Kinda like you get a trial AFTER your arrest, and yet the 4th Amendment isn't violated. Funny how that works.

That would happen AFTER you commit a crime. Something you DON'T get a chance to here....its like that movie with Will Smith where they arrest people for THINKING about committing a crime....Why am I not surprised *******s are going along with this like sheep over a cliff.
