Are you sure you want to bring up the guy who led the actual army, in the field, to deal with a bunch of armed yahoos who felt the Federal government's laws didn't apply to them? Perhaps not the strongest case to back your argument.

If we cloned Washington, introduced him to the situation in Oregon and to the concept of "helicopter gunships", it would be over one way or another in days.

Wrong. Settled in Houston v Moore.

The 1795 Act for calling forth the militia gives the President or state governments the right to call out the militia in the necessary number, and it's not a suggestion, either. And Congress' power extends to disciplining the militia directly as well as dictating to the states how the militia must be disciplined.

Well, I can read.

The yokels in Oregon may call themselves a militia, but they're very much not the militia, as defined in the constitution. They're rather on the other side - sedition, insurrection, that sort of stuff.

Anyway, for those actually interested in the Militia Clause, here's a good link - sorry, short on animated waving flags and men in tri-cornered hats, but long on footnotes and facts.

Annotation 42 - Article I - FindLaw

Government doesn't get to decide who is or is not the militia.... That is left to the people, according to the 2nd amendment. It is not a right of the government to militia.

You really should try reading the entire thing, not just the 2nd. Seriously, it's been settled almost 200 years ago. Article 1, Section 8, Clauses 15 and 16. Enumerated in the 1795 law for calling forth the militia. Deal.

A bunch of tobacco-chewing yokels with guns don't get to call themselves the militia unless they take orders from government. A militia? Sure, if they think it's a fun name to adopt. The militia, as outlined in the Constitution? Not a chance.

Also, militia isn't a verb.

Mainstream press now getting on board to watch the phony, self-styled "judge" put on his performance:

Self-appointed 'judge' arrives in Burns to ask local residents to charge government officials with crimes

Bruce Doucette, from his linked in page

" A self-proclaimed "U.S. Superior Court judge" who has been involved in past property rights protests in other states arrived Tuesday in Burns with plans to convene an extra-legal "citizens grand jury" that he said will review evidence that public officials may have committed crimes.

Bruce Doucette, a 54-year-old owner of a computer design and repair shop in suburban Denver, told The Oregonian/OregonLive, that he made the trip at the request of Harney County residents. He said he met with the armed occupiers of the Malheur National Wildlife Refuge to hear their evidence, which he called "significant," that government officials have committed crimes. "

The above linked article is well, well worth a careful read to begin to understand the methodology for the second act of this amateur production:

"Court"...

...peopled with self-styled "judges", "grand jurors", "attorneys", "witnesses", "experts", "bailiffs", "marshals", "jailers", "clerks" and assorted "writ writers" -- all from the nebulous, alternative universe of the "sovereign citizens" movement.

Let us hope that they confine their "courtroom" antics to "trying" various county and federal officials in absentia, rather than undertaking to kidnap them.

Note that from all available information, the "patriots" are planning to charge the local Sheriff and various others with outright "sedition", quoting from archaic -- but extant -- statutes which require those convicted to be hanged by the neck until dead. At noon, or some similarly dramatic wording. I looked it up on the Cornell law library webpages, from which other pundits have quoted the exact statures.

This could play out badly even if they undertake "court" in absentia, and put out a "bounty" on those "convicted", and declare them old school "common law" "outlaw" according to medieval (Robin Hood style) English tradition.

Or -- less likely in the real world, but still highly possible -- they could put out "warrants" and "subpoenas" for every resident of the county who happens to be on the county or federal payroll, and manage to "arrest" (kidnap) themselves some county agricultural agent, librarian, notary public, mail carrier, or federal retiree. Or even to "subpoena" a "witness" to some "crime" like Sally Sue at the bank notarizing a car title.

Armed nutjobs (of which there are currently no shortage in the vicinity) could go around with spurious, confabulated "warrants" and "subpoenas" to "bring in" all sorts of workaday average citizens, ie to kidnap them.

Surely they can't be that stupid. Or are they?

Mainstream news source Oregon Public Broadcasting releases this shocking story:

Militants Use Government Computers To Create Own Website
by John Sepulvado and Amanda Peacher OPB | Jan. 12, 2016 3:57 p.m. | Updated: Jan. 12, 2016 5:39 p.m.

Among the militant members who have accessed government computers at the Malheur National Wildlife Refuge, one is an Islamic State sympathizer and Adolph Hitler acolyte.

Occupier David Fry said he drove from Ohio – through a blinding winter storm – to help Bundy and his supporters.

Fry’s Google+ account shows the Ohio man regularly posts anti-Semitic, homophobic, and pro-Nazi propaganda on social media.

Fry also posts in support of ISIS.

“ALL I WANT FOR CHRISTMAS IS FOR ISIS TO NUKE ISRAELHELL!” he wrote on the site Nov. 30.

These are not nice people.

These are dangerous people.

Just because they wave the American flag and look like characters off of Bonanza... means less than nothing.

The above linked article is well worth reading. It includes a video in which Fry shows himself accessing a government computer, and boasting how he used the computer to create a website for supporters.

Yes, and I want you to know the company you are keeping if you are a supporter of the armed takeover and the spurious "sovereign citizens" "common law" "court" they are setting up.

But by cagily identifying yourself with "protesters" in general, you place yourself cleverly outside of the Cabal Camp, as there are pro-wildlife-management, and pro-wildlife sanctuary protestors there as well. One of them ripped the squatters' plastic covering off a Malheur Wildlife Sanctuary sign on video yesterday. And he did so legally, like any citizen picking up trash alongside a highway.

I can't think of any good reason why the federal government should own 80% of the land in Nevada, and 50% or more in many other western states.

Those buildings aren't empty. BLM employees have been told to work at home or they would be working in those buildings. Even then they have been harassed by the Bundys at grocery stores. It pisses me off that they are using USFW trucks and tractors, going through files in the offices, including personnel files, cutting fences.
