There are situations where both upward and downward departures from a report are justifiable. However, 90% or more of the time, a competent judge will be following these recommendations.

Its easy to be an armchair general and second guess what a judge does. Its a helluva lot harder to be a judge and have to decide these cases one at a time. There is no specific sentence that is often perfect in a particular case. There are ranges that are better than others. I think somethings are simply better left to the discretion of a person who is in a better position to review this matter than members of the general public are. Judicial decisions should not be argued and second-guessed like political decisions are. The idea is that judges rise above all of that. Any judge who appears to be acting appropriately enjoys my respect.
2 men, both no priors, both athletes. One rapes an unconscious woman, is caught in the act, there are witnesses, evidence, get 6 months. The other is 16, accused of raping a 15 year-old. No witnesses, no evidence, gets 15 to 25 years, and after serving 5 years the victim recants the accusation.

It doesn't take much more than common sense to see something very rotten here.

Is it possible that this judge was bought and paid for? Unfortunately, judges have no accountability, and really can do whatever they want.

The reality is, this situation happened because progressives worked diligently to destroy all the barriers that once exited between men and women. That whole gentlemen thing.

we are here because it is perfectly reasonable for a girl to go out get rip roaring drunk all my herself at some college party and pass out.

That is now reasonable.

Progs created this reality. then get all hot and bothered when a guy gets rip roaring drunk and takes advantage. you expect the people you have allowed to morally get insanely drunk to remain reasonable and capable of sound judgment...

That simply cannot happen. getting stinking drunk ruins reason. eliminates sound judgement.

Progressivism has created some strange moving target of morality. A moral code based on nothing more than how one feels at the time....

you took down all the signposts and cultural norms and traditional moral guidelines. you eliminated god from every sector of society and demanded that everyone agree with you.

Now you reap the whirlwind. THIS is what happens. THIS IS BECAUSE of your Progressive actions and THIS IS EXACTLY WHAT WE SAID WOULD HAPPEN.

Now we have a guy who likely is just a regular guy who would never act like a sick person under normal circumstances GUILTY ( and he really is guilty) of a sex crime.

and we have a young lady that for this incident would have lived her life never knowing the violation and never having to deal with the incredible hardships of the mental stress this violation caused.

Progs set the stage and now are outraged at how this drama has played out.

you own this. Its your fault.

It would seem you need professional help.

If it had been a privileged minority class, let alone a criminal alien, they most likely wouldn't serve a day. And the victim would be made to apologize for "white privilege".

WTF......What The Fudge....

I'm curious. Can an appeal backfire and result in more jail time?

Besides, no money to be made by arresting a rapist-the focus is on revenue generation. More effort put into speeding tickets than solving crimes.
