Actually, I'd prefer to go in the opposite direction and make the background check instantaneous, or at least make it faster than three days.
It is instant in many places if not all. Here in AZ it's cash and carry, same with MT. In both places you walk in, pick out what you want then fill out paperwork. A few minutes later they come back and either let you take it or tell you there's a problem.
If this is what these lawmakers want to do, hey, have at it!
Personally, I think it's a waste of time and money and resources that could be better spent on these issues. While they sit petulantly and wait for someone to give them what they want they could be, you know, NEGOTIATING.
Meh...let them sit on their arses. They'll decide they have something better to do soon enough. I say it doesn't last another day.
That's your opinion, and indeed there are some people that try to make the argument that the "subject to the jurisdiction thereof" refers to the parents' jurisdiction, but the current general opinion of most legal scholars in this country is that people born in the United States are indeed US citizens.
Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
And while knowing EXACTLY that, SCOTUS ruled Wong Kim Ark a US citizen based on the fact that his parents were permanent residents of the US at the time of his birth:
"The evident intention, and the necessary effect, of the submission of this case to the decision of the courtupon the facts agreed by the parties were to present for determination the single question stated at the beginning of this opinion, namely, whether a child born in the United States, of parent of Chinese descent, who, at the time of his birth, are subjects of the Emperor of China, but have a permanent domicil and residence in the United States, and are there carrying on business, and are not employed in any diplomatic or official capacity under the Emperor of China, becomes at the time of his birth a citizen of the United States. For the reasons above stated, this court is of opinion that the question must be answered in the affirmative."
What Gray has done by stating exactly such is to specifically stipulate that parents "have a permanent domicil and residence in the United States" in order for their US-born child to acquire birthright citizenship.
Illegal immigrants don't have a permanent domicile and residence in the US because they are in the country illegally. They shouldn't even be here at all. Therefore, their US-born children are not US citizens.
Granting US citizenship to anchor babies is no more than policy overreach, supported by neither the 14th Amendment nor federal statute.
Cars need to be ban, to keep the drunk drivers off the road.
I'm all for a no-drive list. Anyone with a ticket gets put on, obviously they don't know how to drive. We will figure out how to get them off the list later.
