John Hinckley was found not guilty by reason of insanity. I recall his fixation of the actress, Jodie Foster, and his belief that he would gain her affection by shooting the President. Under the law as it was in 1981 (when Hinckley shot Mr. Reagan), Mr. Hinckley was found, by a jury, to be subject to an 'irresistible impulse', and so not guilty (meaning, he lacked the 'intent'). The public was upset, and so Congress took up the issue.


In 1984 President Reagan signed into law 18 U.S. Code 17, providing:


"(a)Affirmative Defense. It is an affirmative defense to a prosecution under any Federal statute that, at the time of the commission of the acts constituting the offense, the defendant, as a result of a severe mental disease or defect, was unable to appreciate the nature and quality or the wrongfulness of his acts. Mental disease or defect does not otherwise constitute a defense.



(b)Burden of Proof. The defendant has the burden of proving the defense of insanity by clear and convincing evidence."


From what I have read over the years, Mr. Hinckley has regained his faculties.


I agree with the poster that Mr. Brady was ruled to have died of the wound he suffered that day long ago. However, it still remains that he was found not guilty due to his mental status.


Indeed, it is my firm opinion that we have many, many people running around that would qualify for the insanity defense. They literally can no longer distinguish between 'reality' and whatever pictures and thoughts are being formed in their head.


It is easy enough to detect such insanity at times, like that woman whom killed her infant son believing that she had given birth to the Devil, although in other people it is much harder to detect, until they act out.


Even in my job, I have seen a marked rise over the past quarter century in people whom have developed severe psychotic disorders. Often they are abusing drugs and alcohol.


I have one childhood friend currently in prison that was always a bit 'off' (bipolar, most likely, as well as OCD), but he functioned well for decades, until he fell into chronic drug and alcohol usage, finally culminating one night in a series of burglaries and sexual assaults.


He did not plead insanity at his trial, for by the time of trial he had been off booze and drugs for several months and began to recognize that he had literally 'gone insane'. We still keep in contact, and he hopes someday to get out and counsel others whom are addicted. Poor lad (he is now 62), he is hoping for parole this coming fall, but it is his first time 'up', and no doubt he will be denied. The victims will have much to say about it (including the person or persons he sexually assaulted).


It is sad all the way around.

I read something years ago about it being part of a group that supports certain government leaders - and Reagan fell outside of that group. I can't remember the details though.

Allow ME. I have no mixed feelings.

This guy shot a president, a police officer (forced to retire due to his injuries), a SS agent, and let's not forget James Brady.

He's had an increasing amount of freedom (bowling, picnics, outings, home visits) at that institution, along with a number of questionable "girlfriends"--not the least of which was his one-armed paramour. She killed her 12-year-old daughter with a shotgun, then tried to kill herself with it, and shot off an arm, instead. He really knows how to pick 'em, but I guess people of her ilk and illness are all you find in a place like that.

He should stay there.
