Aught oh... Looks like if you have a medical marijuana card you can't legally buy a gun...as such can't legally own one

Yep, not new. You can smoke pot, or defend yourself. Not both.

Some states will issue a ccw if someone has a med dope card, others (like UT) won't. So technically someone can have a permit, but not a gun. The 4473 form has a question about use of illegal drugs. This is apparently held to include possession as I understand the Fed law. My knowledge the mandate stems from an ATF "Finding" not actual legislation.

A number of sheriffs have said they will not enforce the Federal laws. So technically you can't buy a gun, but if you have one unless the ATF goes after you, you won't be persecuted.

If you do defend yourself while impaired this ruling could reinforce court actions regarding exercising good judgement.

I think this will eventually be overturned as more states move to recreational mj.

MEH, after CA passes Prop 64 the rest of the states will follow like dominoes.

If it's legal for recreational use there will be no cards.

I fear people with guns who drink alcohol. I fear pot heads will buy out the nacho Doritos at 7/11

Read the atf 4473 form.... Recreational or not... I don't see a change..feds will keep control. The language of addiction will be on the buyer..and when they lie... Another reason for the feds to come after you. There will be a challenge to the language and the courts will codify whst addiction means..daily use..weekly use.. multi days use..who knows... More bs for the magic green plant

Can't imagine using a gun while high anyways...gives new meaning to whacky tabackey

Prop 64 only means a heap full of new laws... If it passes...now that small growers are not getting behind it in droves..it will only be the end users that push it

to be honest, i dont think anyone under the influence of anything, legal or not, should be carrying a firearm in the first place. should they be prevented from owning them? not unless they have a conviction on their record.

This is true. And I don't think all felons should be prevented from owning a gun either. "Prevented" is probably the wrong word since they aren't prevented at all. It's just illegal.

Besides, I didn't know addiction was a crime. I also didn't know lying was a crime.
