"Breitbart News is preparing a lawsuit against a "major media company" over claims that it is a white nationalist website, it said in an exclusive statement to The Hill."
My questions:
Will they go through with it? I do not know. I assume so, else they would not have given The Hill the statement.
Is it truly 'libelous' for a news organization to refer to Breitbart as a 'white nationalist' website? Depending on where the lawsuit is filed, it probably is not 'libel per se' (or, libel that proves itself).
If the claim is libelous, what kind of monetary damages could Breitbart claim? $1.00? $1,000,000.00? Depends on what the jury concludes is Breitbart's 'reputation'. There have been such suits before where the plaintiff 'wins', but is awarded the nominal sum of $1.00, because the jury decided the plaintiff had a crummy reputation, to begin with.
Is this a wise action by Brietbart? No, it is not. Brietbart will regret filing such a lawsuit. The defendant will have an absolute right to depose Brietbart writers and contributors, past and present, as well as investigate their background; examine any comment section (if such they have; I have never gone on the website); look at their advertisers; and who knows what else. Such suits can only really be filed by those whom have clean hands.
