Interesting how federal MJ law trumps state MJ law regarding firearm purchases, however state and local governments are able to continue restricting the natural right of bearing arms outlined by out 2a. Ex chicago, maryland, nyc, sf, etc.

It's unlawful for a municipality to deny a citizen their right to bear arms within those areas if indeed fed law trumps state law in the marijuana example Op linked.

Just another example of the fed's double standard. They will do whatever possible to restrict your rights but never go out of their way to ensure your freedom unless successfully challenged by the court.

I hope Trump can get through nationwide CCW. These individual state restrictions really are unconstitutional.

The 9th confirmed federal jurisdiction over rules state on legality of marijuana.

However the SCOTUS already affirmed that felons receive 5th Amendment protections for lying during the completion of a 4473.

I can't see how under the 5th the new question would not violate the right to non-self incrimination.

I think it's been covered, but worth noting. The NICS system (National Instant Check System) is rejecting people violating federal drug laws. Purchases are rejected for those possessing "medical MJ" cards. Lets hear it for universal background checks, right?

People that drink alcohol should not have firearms.


Unconstitutional!!!

Shall not be infringed, just got infringed further.
The government has no authority to determine who has arms. It says people and is not specific for a reason. If it were specific it would take individual liberties.

Actually that may violate the Roe v. Wade judgment.

Medical MJ cards are issued under Dr. Patient confidentiality. Roe v. Wade removes the government involvement in a medical decision because of Dr. Patient confidentiality, and to permit physicians to practice medicine freely absent a compelling State interest. Denial of a clear BGC for a medical decision being a violation of the 14th Amendments due process clause and right of privacy.

If the principle that government cannot deny rights because of a medical decision applies it applies in all circumstances.

Yep, the fact is it is none of the governments business (or anyone else for that matter) who owns a firearm.

Nothing new here.
The old form wording went like this...

"Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?"

They are just clarifying that under federal law you are illegally using MJ even if it is legal in your state.
