One of the traditional signs that a justice may retire is the announcement (or rather the lack thereof) of law clerks for the next term. Justices hiring a full slate of law clerks for the coming terms almost certainly aren't seriously considering retiring.

UPDATE (12/23/2016, 11:20 a.m.): We have learned that Justice Kennedy has hired two clerks in addition to Harper, for a total of three, and he will hire the fourth early next year. So folks fearing (or hoping) that President-elect Trump would get to replace AMK in short order should be relieved (or disappointed). We think we have these clerks’ identities, but please drop us a line if you can confirm them for us.

The Supreme Court is not about representation.

This is why I always think the hypocrisy of saying we need more conservative or liberal judges is inherently against what the Supreme Court is all about.

This is a both parties complaint so nobody say -- yeah those liberals or yeah those conservatives...both parties do it.

The minute the President (any President) says they want to nominate a more liberal or conservative judge they are implying the Supreme Court is about representation.

I'm anxious for this group to get moving on making decisions to see how they work.

This is so American politics right now. It's all about the revenge.

I get it - -Ginsburg was an idiot to express out loud her views...she shouldn't have....but your statement just speaks volumes on how both sides of the aisle think right now and how our government runs right now.

Ginsburg showed her lack of impartiality with those comments, which is reason enough to want her gone. But, her ridiculous statements aside, this isn't about revenge (don't know where you got that from). Its about a desire to replace one of the most hardcore leftist justices on the Supreme Court with one who has a more modest view of interpreting the Constitution.
