It appears he had a 5 year B2 tourist visa with unlimited entry to the US but can't stay more than 6 months at a time. Tourist visa holders are not allowed to work or study. It appears he was using the tourist visa to live full time in the US.

Looks like the guy attempted to depart before his visa expired. Canada would not accept him and thus, his visa ran out of time.

I'm disturbed by a couple of things, here:

1) Canadian officials seemed to have behaved very foul. Whether or not the US would renew the guy's visa or not should have had no bearing on Canada's decision to enter their country as he could enter their country without a visa simply due to the fact that he had an Australian passport. Note, I find it funny that Canada is willing to allow scores of illegal immigrants but didn't want to permit what would have been a lawful Australian visitor to their country.

2) But I'm also disturbed by the followed screech from the GoFundMe page:

This is going to make a criminal out of an innocent man. With this legal counsel his options are still limited, either get sent back to AUS with no criminal record, or have us get married so he can be here legally – both of which we are willing to comply with.

Here we have the whole "criminal record" thing again, which has arisen due to the left's focus on calling illegals "undocumented." The fact that the guy would have no criminal record is immaterial to US immigration officials as he broke the law (whether he violated the criminal code is irrelevant to this determination) by overstaying his visa . . . US immigration officials can only concern themselves with what is before them and should pay no mind to the admittedly shady actions of Canada.

Moving on, if the woman wants to marry the guy (hopefully he is deported before any formal marriage can be arranged), then more power to her. But based on the woman's own words on GoFundMe, any marriage would appear to be a sham marriage under the law as it would appear to be done only for immigration purposes.

Canadian Immigration can be disarming with their "Hey how's it going buddy?" approach.
If he told Canadian Immigration that he was just there to reset his US tourist visa they could deny enter.
If he lied to Canadian Immigration and they found out then he could be denied entry.
He obviously lied to US immigration, he had a US tourist visa but had no intention of returning home before it expired - was using it to live/reside in the US with his girlfriend.
It's not the 1 hour that tripped him up, it was lying to US Immigration and using the tourist visa to live in the US.
