Civil action with a lower burden of proof and a jury packed with people that either believe Brown was killed or are interested in sending a broader message or just want to give his family some insurance company money.

Malpractice suites often get more than 1.5 mil.
Most of the big dollar malpractice suits involve a person that survived that requires extensive costly future medical care.
For a death claim it's much harder to collect a lot.
