In Virginia, the protesters blocking the street were committing the crime, not Fields, who was driving well below the posted speed limit.

"On Monday, the 13 defendants, all represented by the same attorney, were convicted of obstructing free passage of others, punishable by up to a year in jail plus a $2,500 fine.
One by one, the 13 defendants went before Judge Jacqueline S. McClenney and pleaded guilty to obstructing free passage of others. "
It was I-95, a major highway that was blocked back in 2016. The Richmond area Police departments and state police who work together would not let a Charlottesville type of event become anything close to the type of mayhem that happened there.

Well, gosh, we might as well let Neo-Nazi Fields out of jail because he was going the legal speed limit and people were illegally standing in the street. Take note all would-be terrorists: You can plow your car into crowds of people in America if you just do it below the speed limit. Pick out a state fair or music concert and hope you a few posters here on your jury.

[quote=Wayland Woman;49318715]Does anyone have any video footage of Fields being arrested? Does anyone know if he said anything during the arrest or after? For all we know he was bragging about hitting those people, proud of his deed. He was a brave little Neo-Nazi, after all, marching with his Tiki torch the night before and carrying a shield and pole just hours before. He would have been pumped up on adrenaline. He wasn't a scared little Boy Scout like a few posters here are trying to make him out to be.[/QUOTE
Haven't seen footage of his arrest. Usually, when people confess its reported. I suppose they could be keeping it close to the vest.
No one is saying he's a Boy Scout.
Having personally experienced someone banging on my car as it was moving, it is a startling experience that induces an instinctual fight or flight response. No different really than being personally physically assaulted imo.
Someone who is willing to basically "assault" a moving car is crazy imo. Who knows what they will do next.
The DA isn't going to be able to prove that. His car was attacked from behind before he accelerated to flee. Result: 3-car accident, and unfortunately injuries and a fatality.
His speed up to the point he was attacked from behind by a thug with a flagpole was only 17.4 mph in a 25 mph zone, and he was slowing down as he approached the congestion. You can see his brake lights lit as he passes the bicycle on the right.
Do the math... His car traveled 97 feet in 3.8 seconds, according to Brennan Gilmore's video that tracked the car in real time as it proceeded forward from Main St. His car was then attacked from behind, and he fled forward.
It was I-95, a major highway that was blocked back in 2016.
Look at the charge the guilty plead to:

Obstructing free passage of others, not restricted to major highways only. Just "obstructing free passage of others."

Fields was driving BELOW the posted speed limit, and yes, the protesters were illegally blocking his free passage.
When all is said and done, they will not be able to prove intent and the most that will stick is involuntary manslaughter.
However, that being said juries despise when DA's overcharge so its possible Fields will walk as an accidental homicide due to others striking his car and either causing him to accelerate or impeding him from braking in time to avoid accident.
You're fixated on intent. Here's what two Virginia criminal law firms have to say about 2nd degree murder and intent:
"Just what constitutes “malice” can be a moving target. It can be explicit, meaning you intended to injure or kill someone or you can have malice without intent. Sometimes it can simply mean extreme recklessness, in a form of murder known under common law as “depraved heart murder,” or knowing that your actions have a very high risk of causing death and simply not caring."
"Malice is a major element of this crime. It can be many things, such as intending to injure or kill someone, having malice toward someone, but not intending to kill him, or being extremely reckless."
There's a crime called reckless driving that can apply, regardless of a speed limit.
And depending on how clean his driving record is, he may walk with time served and a fine.
