In some states you are not allowed to defend yourself, but Michigan does have a castle doctrine law. Makes no sense.

I am not an attorney, but this much I do know.

The unfortunate part is when people read or hear about these kinds of incidents and they think whenever they decide they might be afraid of something, they can shoot, That isn’t true. You really have to believe your life is in danger, that you’re going to be harmed.

In this case, the Marine seems to be the only one got shot in his own house. So this whole thing just makes no sense.

Depends. You don't get to grab a gun and go outside and shoot someone who was knocking on your door.

He (the Marine) did not do that.

According to his own father, he did go outside to confront the man with a drawn weapon. And no, he did nor shoot the man, but my comment on that was a reference to Floorist's remark about the Castle Doctrine law, not what actually happened.

Cracking the door frame Nelson’s family says Joey grabbed his gun and yelled for Wilson to leave.

“He opened up the door because he was standing here in the yard,” Steve Nelson said.

He did not injure anybody. He was the one got shot in his own house.

This is exactly what happened!

He is now charged with several felonies, including assault with intent to murder. I predict this charge will be dropped.

Nelson’s family says the young Marine was shot in the hip before calling 911 and telling everyone to get downstairs. Joey Nelson fired back at Wilson who they say took off as police arrived.
Although Joey Nelson is charged with several felonies, Michael Wilson is only charged with carrying a concealed weapon.
“This man out here in the front yard fired multiple shots into a house with multiple people inside and a 3-week-old baby simple and he’s (only) charged with concealing a weapon illegally?” asked Steve Nelson.

I edited my post to clarify the context of my earlier post. No, he did not hit anyone, but he DID go outside with a drawn weapon to escalate the situation.

Like I said, the felony charge of intent to murder most likely would be dropped because it makes ZERO sense.

Unless he shot first, which does not seem out of the realm of possibility. The way this was charged strongly suggests that that's exactly what happened. Keep in mind that at least some of the people in that house were drinking and had illegal drugs - if he was using any, his judgment could have been considerably impaired.
