This latest decision is specifically designed to get it to SCOTUS asap by fulfilling their requirement that it be heard in the lower courts first.
Since SCOTUS is and will be the final word I could care less what the lower courts try and legislate from their bench...

According to the US Constitution, Trump does not have to.
