Except that age discrimination laws apply to companies that employ greater than 20 people (some states have additional laws towards companies with less than 20 employees).

IBM is bound by those laws, as are all companies private or public. Clearly IBM skirted those laws to boot older workers, and all people should have a problem with that.

Yes I am aware of how it is rigged by the state. Why shouldn't a business owner have the same rights, as say a homeowner?

IBM is trying to rejoin the tech industry. It needs new ideas, new blood, a change of the guard. Out with the old, in with the new. It can keep the people who brought it to its present state or bring in new ones.

Not a private company. IBM is a public company and thus owned by its shareholders.
