Can I change that to No? I think crime has a genetic component but it isn't the only component.

The fatherless families criminals are born into is also a factor. Fatherless families that cluster together result in areas where criminals have only each other as examplars. The choices they see are various criminal alternatives: Drugs? Robbery? Maybe work up to murder? And they have gangs to provide career paths to the best (or worst) application of their skills and interests.

This may work on you because you are a civilized person but it may not work on them, may not convince them to be civilized, so two things.

First of all, if you are totally hard ball on them, who are you going to get to work in the prison in the first place. Or is it just going to be a tall wall enclosure that you drop prisoners into?

Secondly, "make it a horrible experience that they don't want to repeat" does not necessarily mean that it will make people who have been there behave on the outside. All it means is that they don't want to go back and will do anything to avoid that.

They know that the current world is against them and that sooner or later, they will be sent back. So to prevent that, when they get out they line up a bank job so they can get the cash to skip the country. So they shoot and kill the police officer who was stopping them for a traffic violation.

Up the ante as suggested will most likely up the violence in our world.
