I have global entry and they are very clear during your interview that you MUST declare everything or younrun the risk of fines and revocation if your privileges
^This. All of that food was loaded onto the plane but wasn't inspected?
That's actually an interesting question. If an aircraft takes on food overseas, is that food considered cleared for US import? What if it's a foreign-flag aircraft?
You have to say you don't have fruit, meat, etc. I guess it could have slipped her mind.
Here's the thing -- those immigration officers have a large span of power or control. The officer could have thrown it out and warned her or he could have been a smart ass ...he chose the smart ass comment and actions.
You just don't take chances with immigration officers...they are in charge and that's that.
realistically, if the apple was used by the airline company, it already passed customs
they should not have "held" the item since it was "pre-checked"
Wrong. The plane came from France. The aircraft had catering done in France. So how was it precleared? International aircraft arrivals have to dispose of their garbage in specific international bins that are hauled away and the contents burned or sanitized.
Uh, she is s member of the Global Entry program. They are held to a higher standard than regular travelers. It’s called trusted traveler. Forgetting to declare is grounds for expulsion and fines from the program. She knew that when she applied and was accepted into the program.
Charging $500.00 for an effing apple is just stupid.
This reminds me of the EPA, the FDA, the IRS, the FBI, the CIA, the NSA, and such.
It seemed like an innocent mistake and an opportunity to capitalize on it. Thumbs down to Delta.
Delta? Seriously, if there is one actor in this that has no culpability, it's Delta.
Don't check the box saying "I am not carrying any fruit" when you do, in fact, carry an apple. Don't sign up for Global Entry and promise that you're a seasoned pro who knows the ins and outs when you obviously don't.
Was the agent a bit of a stickler? Yes. But I wasn't there, I have no idea what went down - I do know that attitude can get you into trouble right quick, and as whatshername has now decided that it was the airline's fault for not holding her hand, I guess one can reasonably doubt that she stepped up to shoulder the responsibility when it was first called out. Which is one way to get on the wrong side of any official.

It should.
