Experimental drugs are just that: not proven to work or to be safe. Patients can die sooner and in agony from experimental drugs, especially those that have only gone through tiny, preliminary studies of a few healthy volunteers or patients (as the proposed national law would allow).

Only about 15% of the drugs that complete those types of preliminary studies are eventually proven to be safe or effective. The other 85% are either not safe, not effective, or both. That is a very important reason why most patients (and their doctors) do not seek experimental treatments even when they know they can

One of the cornerstones of Universal Healthcare is the MD comprised Comparitive- Effectiveness Panel. These panels evaluate the cost, side effects/ quality of life and outcomes of new medication versus standard applications.

The US does not have Universal Healthcare. Comparitive- Effectiveness is left to healthcare providers. Sloan Kettering independently created their own Comparative- Effectiveness models for Cancer treatment with emphasis on cost- benefits. Not all Cancer Treatment operations do the same.

US Healthcare providers who administer pharmaceutical treatment in their own facilities are paid a percentage of the cost of the medication by Medicare. The higher the price of the medication, the more the facility makes.

It has to do with how many more people a drug company will charge. Currently they want to limit people for trials who have the best chance. This is because they want good clinical results. Now, with this hope they can sell to someone who is beyond hope because it will not affect their trial stats.

"The legislation pushed by Sen. Ron Johnson (R-Wis.) and Rep. Andy Biggs (R-Ariz.) would forbid the federal government from interfering with the state laws and would exempt doctors and drug companies from liability for prescribing or providing experimental drugs. It also would limit the FDA in an unprecedented way: If a patient were injured or killed by an unapproved treatment under a right-to-try law, agency officials would not be allowed to use the information to delay or block approval of the treatment."

And? Thats not a bad thing to be honest. The trials that are being performed to determine if a drug is approved or not are very very carefully designed. And I assure you that the manufacturers will be looking at those deaths carefully, because while it cannot be used to delay or block the release of the drug, it could absolutely be used in a wrongful death lawsuit after release of the drug.
