If you stay consistent with Booker's argument--then Trump shouldn't have been allowed to fill a cabinet, especially by picking the Attorney General, the FBI, and CIA Director along with Secretary of Sate, because arguably they are all linked and involved with investigating and participating in the accusations of collusion.
In law enforcement, when a cop is subject to a criminal investigation--they modify or suspend them, and take away their gun and badge and CANNOT participate in law enforcement field activities until they are cleared.
Trump has NOT has his "gun" and "badge" removed so to speak. Taking away his SCOTUS pick is tantamount to sending him to be a police officer without all of his tools to work with.

Sen. Booker makes a good argument. As long as the Trump administration is under a criminal investigation, there is an inherent conflict of interest for Trump to pick Supreme Court judges, because they could step in and rule on key parts of the Trump-Russia scandal.
