What is "proof?" Rapes are usually extremely difficult if not impossible to "prove" so if we go by your reasoning most rapes should never be prosecuted.
Rape cases that go to trial ALWAYS have more than "he said-she said" proof. The prosecution couldn't meet its burden of proof otherwise.
