I would think the essence of an "emergency" is something that just cannot wait. By deciding to wait, he may be showing it is not an emergency. You don't consider declaring an emergency, you just do it.


He might have a valid case if he were to declare a National Emergency that merely orders essential federal employees to be paid until a spending bill is passed.

He is only moving money around. The president can’t change laws or ban things so this is not a problem if a Democrat decides to do something similar.

Guns would seem to be a given. The American Medical Association (AMA) has already adopted a policy calling gun violence in the United States "a public health crisis" requiring a comprehensive public health response and solution. Would think that positions such as this from such a respected organization would make a POTUS declaring a national emergency on guns much easier.

The president can’t raise taxes, ban things or force citizens to do anything against their will. We can simply say no. We don’t take orders from the president.
