If he declares an emergency he will immediately be blocked by a partisan judge and we'll have to wait a year until it gets to the Supreme Court.
First of all - there is no real emergency, so what does it matter to Trump if this is hung up in court?
Most importantly for Trump this whole process will serve as a major distraction from the many investigations that are surrounding his family, his campaign and his Presidency. This will give him an opportunity to complain about our court system and how it's aligned against him, blah, blah, blah.
We know how this story will play out and exactly how our childlike President will behave. Perfectly predictable. And we know that the fools that support King Trump will parrot his every word, and applaud him as he rips away at the Constitutional framework that has protected them their whole lives.
This is so obviously unconstitutional that I am 100% confident that SCOTUS, which is widely viewed to be a right leaning court at this point, is going to reject Trump's attempt to subvert the Constitution. It ain't gonna happen, and Trump is going to look really stupid for trying it.
Trump will look even more foolish if he were to get funding through this route for his wall. The logistics of his "Mt. Everest" are impossible and will make a fool out of trump and the GOP. This folly would go down in the history books of our country!
The SCOTUS would actually be doing trump a favor by rejecting this.
We've already seen a tweet from 2014 with Donald Trump saying Obama using his executive powers to declare an emergency would be wrong....
Now, a video of Vice President Mike Pence has surfaced from 2014, with Pence saying Obama using executive powers to go around Congress would be a "profound mistake."
This is such an extreme example of what is wrong with politics. If a democratic president decided to declare a national emergency to get money that Republicans didnt negotiate, McConnell, Hannity, and City-Data Trump voters would be screaming their heads off.
"If my side does it, awesome! If the other side does it, abuse of power!"
i hope and pray that this is one thing that when the Democrats are in power they dont say "Well the Republicans did it first so we can do it." Hopefully this loses in courts so we dont ever have to worry about it again.
Agreed and one of the repercussions of this is that Congress may be forced to rescind or revise the Emergency Powers that were granted to the President. All because we elected a President that was willing and able to abuse those powers.

I don't know enough legal stuff to argue for or against but I think if somehow this goes through -- it then becomes what Presidents do...
it is what presidents do. its been done 50 times since the 1970s when the law was changed to place some restrictions on this. before that it was really really what presidents did.
