Well what counts as 'hate speech' exactly? Are we talking about just regular conversations which anyone can report, or does it have said in a newspaper or something for the person to actually indicted with a crime?
As demoralizing as free speech in the U.S. can be, thankfully we have not stopped this low like Brazil because otherwise our prisons would be even more crowded.

Well, the US does now have 'hate crime', which is usually considered to be worse than regular crime...so I guess we are on our way!!
Racism and hate speech is already a crime in Brazil. That is to say, a person can be jailed for simply expressing a racist opinion. It's been that way for a long time.

Do they fear that they're going to have this right taken away, by creeping liberalism? Is there some place in the Constitution where it guarantees the right to say hateful things? Maybe they'd like to try to add an amendment that would give them license to do that? You can see where this country would be headed, if these people were able to gain dominance.

I live in Canada which has passed some hate speech laws as well, but no one ever seems to be prosecuted for it. Perhaps prosecutors just don't want to take a case like this to trial, cause they think it's futile, and perhaps a lot of criminals are never charged even as a result?

Brazil's high court issued this ruling to counter (and hopefully check) the rise of right wing politics including recent election of a president who has made virulent anti-LGBT statements. Also hard core evangelism is making huge inroads into Brazil which once was mostly a Roman Catholic country. Those evangelicals are not that much different than those in the United States in some their views and that includes on LGBT issues.
Brazil is something of a riddle far as LGBT is concerned. It has had same sex marriage since 2013, and long before that a large and visible LGBT community with one of the largest and most famous gay parades. Then of course many of Brazil's beaches/resorts are world famous for being gay friendly if not outright promoting gay tourism from around the world.
Then there is the dark side; gays, trans and lesbians are routinely beaten, discriminated against and otherwise suffer in Brazil. President Jair Bolsonaro is famously anti-gay and his election may have been helped along by those in support of his stance on homosexuality.
Action taken by Brazil's highest court is meant to serve as an interim measure until that country's Congress can pass legislation codifying these anti LGT's violence measures. This is going to be an interesting thing to watch as it may come down to a battle between an ever right leading Congress, and pro-LGBT high court largely appointed by left leaning former presidents of Brazil.
If the bill to include gays, trans and lesbians from hate speech and violence does not pass in Congress with a veto proof majority, and or Bolsonaro does in fact veto the bill that is going to set the stage for a battle between legislative and judicial branches of government.

Brazil is and always has been a society with eyes focused on the continent of Europe its economic and social policies everything was shaped by the European look .... In the name of order peace is accepted by Brazilians that certain freedoms do not be given to people and it's okay for them.
what the Brazilian Supreme Court did was no different from what has already been done in several European countries or Canada
Brazil has a lot more problems with crimes against gays and transgender than we do. 420 were murdered in 2018.
