Another unfortunate cruise ship incident...thoughts?

Quote:
The cruise ship operator Royal Caribbean must answer accusations that it was negligent over an incident in which a group of men allegedly plied a 15-year-old girl with alcohol before taking her to a cabin aboard one of its vessels and gang-raping her.

A district court in Florida had dismissed the girl's negligence lawsuit against Royal Caribbean over the 2015 incident for failure to state a claim, ruling that she had not sufficiently alleged the operator had breached its duty of care and proximately caused her injuries.

But that decision was reversed on Wednesday by the U.S. Court of Appeals for the Eleventh Circuit, which concluded her claims were, in fact, sufficient to allege that Royal Caribbean was negligent towards her.

According to the girl's complaint, K.T., as she is referred to, was on a seven-day cruise with her two sisters and grandparents beginning the day after Christmas.

She alleges that on the first night, in full view of Royal Caribbean crew, a group of men bought multiple alcoholic beverages for her at public bars until she became "highly intoxicated," "obviously drunk, disoriented, and unstable," and "obviously incapacitated."

Where the hell were her grandparents and why should the cruise line have to step in and babysit in their stead?

Evidently, the grandparents took K.T. and her two sisters on a 7 day cruise. 100 to 1the girls had their own room and the grandparents were sleeping.

Right -- the kid had adult supervision on board with her so why is the ship's crew expected to babysit her when her adult accompaniment isn't up to the task?

Were the rapists ever caught and charged? And she ought to be suing her grandparents for their negligence.

The cruise ship could be found negligent. Bartenders can be held liable for continuing to serve someone who is clearly intoxicated. If the bartenders saw that these men were continuously buying drinks for an intoxicated girl, that’s a problem. Additionally, did they ask for her ID?

This will be interesting.

Who is to blame?

Simple, the rapists.

If the cruise ship is responsible, so are her guardians, and her relatives onboard should be in prison as accessories to the rape.

The accessory charges wouldn’t stand because there was no knowledge on their part.

my guess is it's going to come down to exactly where was the 15 year old when she was consuming the drinks. all-ages venues that sell alcohol usually have some system in place concerning minors/adults and alcoholic/non-alcoholic drinks ( different glasses, wristbands, hand stamps etc ). if she was consuming these drinks in sight of cruise employees i could see the cruise line getting popped for liability.
