Florida Man Lost His 2A Rights, Thanks To Red Flag Laws And Mistaken Identity

Look for these kind of events to happen at an increased pace and with the same level of bureaucratic "WhoTF cares" dismissal that Jonathan Carpenter is receiving. He isn't the person the tyrannical lack of due process was even after, but he was declared guilty because of same name as intended target, he lost his rights, and must now stand in front of a judge (on his own time and dime) in an attempt to prove his innocence via mistaken identity, and only after all that is complete can he hope to regain what was takn from him on a purely illegal, immoral and illogical basis.

Yeah, Red Flag laws might be the worst thing the government has managed to conjure up in the last 50 years. So ripe for abuse, and so difficult for the innocent to recover, given both the glacial pace and level of retardation common in any level of government bureaucracy.

These stories should be getting way more attention.

Liberals will obviously cheer this, but MAGAs will ignore it because their hero has championed exactly what happened here.

According to this, Florida has issued 2,434 Risk Protection Orders of which 550 involved suspending licenses for 14 days. The link contains the charavpcteristics of some of them. It’s reasonable to assume a small percentage of them were mistaken identity.

Seems silly that when someone can prove they are not the targeted individual, there is not a simple process in place to restore the right.

17 states have some semblance of Red Flag Laws. No two states have the same laws.

No one knows what Trump meant when he said he supports Red Flag Laws and it’s likely he does not know. Might mean state laws or a federal law. More likely just another vague meaningless stance.

They should be getting more attention. And there should be more push back. I'm not happy Trump is in support of them but what can one do ? I'm definitely not going to vote for the side that wants all out bans though.

I was recently denied a firearm purchase due to an erroneous NICS check. I appealed and ten days later the purchase was approved. Of course you are never given the reason for a denial, but I suspect its because I have a relative with the same name who is a felon. I appealed and week later was approved, again no reason ever given. The state is like a parent who says "because I said so" when you ask for a reason.
My question surrounding this story is how did they know he owned guns?

This happened in Florida. The law was enacted by a majority Republican state legislature and signed into law by a Republican Governor who went onto win a Senate race.

Politicians and the media that feeds off then prefer to blame the other party.

Trump is already responsible for more gun control in 2 years than Obama in 8 years. Obama actually loosened gun restrictions.

The three biggest anti-gunner Presidents in the last 40 years are Reagan, Trump, and Poppa Bush. So don't come at me with “sides.”

Exactly. Which is why it angers me when MAGAs and conservatives act like it's the Democrats who want to take away our guns, when it's their own party who is responsible for much of the gun control in this country.

This was a thing before Trump. A good friend of mine spent thousands of dollars to get his firearms back after a "concerned" neighbor overhead a phone conversation he had with family on his patio.

Oh, please. You're much more likely to have your 2nd Amendment rights honored in a Republican state than a Democrat state. And its not even close

Most (and its not even close) of the gun rights legislation and rulings we've had have been because of Republican legislatures or Republican appointed, conservative judges.
