Do you agree that criteria should apply to interpretation of the 2nd amendment?

well if we do, then it ENDS all arguments against the 2nd amendment

It is a natural right which the people have reserved to themselves, confirmed by the Bill of Rights, to keep arms for their own defence; and as Mr. Blackstone observes, it is to be made use of when the sanctions of society and law are found insufficient to restrain the violence of oppression.

as Alexander Hamilton explained in 1788:

If circumstances should at any time oblige the government to form an army of any magnitude, that army can never be formidable to the liberties of the people while there is a large body of citizens, little, if at all, inferior to them in discipline and the use of arms, who stand ready to defend their own rights and those of their fellow-citizens.

There was an ongoing thought in the 1780s about "the people" fighting governmental tyranny .A widespread debate on the ratification of the Constitution, was the possibility of a military takeover of the states by the federal government, which could happen if the Congress passed laws prohibiting states from arming citizens, or prohibiting citizens from arming themselves.

When governments fear the people, there is liberty. When the people fear the government, there is tyranny. The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government. – Thomas Jefferson (1743-1826), US Founding Father, drafted the Declaration of Independence, 3rd US President of the United States

the 2nd amendment is very specific.........the RIGHT of the PEOPLE shall not be INFRINGED

Quote:

Quote:
""""That the people have a right to bear arms for the defence of themselves and their own state, or the United States, or for the purpose of killing game; and no law shall be passed for disarming the people or any of them, unless for crimes committed, or real danger of public injury from individuals ..."""-- James Madison

""The right of the people to keep and bear arms shall not be infringed; a well armed and well regulated militia being the best security of a free country but no person religiously scrupulous of bearing arms shall be compelled to render military service in person.""" James Madison, father of the constitution

the 2nd amendment is very specific...the RIGHT of the PEOPLE shall not be INFRINGED

well regulated means well trained, militia is the stand by for the standing army, the continental army

the right to OWN and CARRY weapons BY EVERY CITIZEN, is just that a right.... and the citizens right has NOTHING to do with the militia

the 2nd amendment is very specific...the RIGHT of the PEOPLE shall not be INFRINGED

Regardless, that would require a constitutional amendment.

Good luck.
As usual, the Loony Left giggles and mocks because they think America is headed down a dead end path. They may be right, insofar as the birthright issue is concerned.
If Trump issues an executive order, the next Clown Car Dem will simply undo it, so that's not the answer.
Seems to me that it takes a constitutional adjustment or one sort or another, and I don't look for any help from the Loony Bin.
Just more reasons to vote all Dems out of power, I think.

Default The People?

Does "The People" mean the inhabitants of planet Earth? All of them? Maybe just citizens and folks who successfully snuck in? Or everybody that wants in?

Unless the executive order is affirmed by SCOTUS.

Flawed logic - terribly flawed.

Why not put out said amendment and run with it?

Dumping birthright citizenship takes 5 members of the SC reversing a 120 year-old bad decision.

Would that make them "activist jurors who legislate from the bench?"....or is that only for one party?
