It's also not simply, "how one feels about their victim." It's whether the crime itself is motivated by an immutable characteristic of the victim. Was someone targeted specifically because of their race, sex, sexuality, etc.?

Would the crime have happened but-for that bias motivation?

Imagine if you will the plight of white S. African farmers, targeted on account of their race. Not that the racist S. African government ever would, but the government there has a motivation to apply aggravating factors to such crimes where it shows a special need to address such crimes.
I do get what your saying but I still think the criminal act should be prosecuted the same for its intentionality (willful, knowingly malice, etc) than what kind of malice or intentional motivation. Attacking someone maliciously because of their race is really no worse than attacking someone maliciously for any other improper motivation in my opinion.

The other problem with hate crimes is their selective enforcement. And I suspect selective enforcement was the motive behind hate crime legislation.

At times, White Person A might be taught to hate White Person B or to feel White guilt when reminded of our past. With all the stories about racial discrimination and slavery, I know I have a feeling of White guilt and self-loathing at times.

Wasn't a big enough kill count I guess, unlike the maga el paso shooter that was inspired by the Hispanic hating white nationalist in chief

To the bolded, it really is this simple.

The OP clearly had an agenda when creating this post, though.

Feelings of guilt of an action YOU had no part in and having " self-loathing at times " is a serious problem and perhaps you should see a Mentor who will help you.
