They still need to charge, convict and sentence, but make the sentence fit the crime. If it is victimless, and non-violent give them fines, community service, house arrest, and/or probation depending on the nature of the crime.
Its not practical to grow opium or cocaine for personal use...too many plants/acreage are needed to make it realistic.
That's why the U.S. government oversees it. They're experts in illegal operations...even the ones that are only illegal because they say so (for us peasants).
