What is the relevant law here?

I remember the railroads UNabandoning trademarks of predesessor railroad lines and demanding money from model railroad companies ca 2005.

Just a case of the biggest money writes the law?

What's worse is that even after a work lapses its copyright in this country, a trademark on a name, image, or sound can prevent you from using it outside of getting a license or nominative fair use! In other words, from a practical standpoint that trademark gives that work a perpetual copyright. Well, the Constitution says a copyrighted work is supposed to be for "limited times". Yes, there is debate as to what constitutes that length. However, our country's life+70 for many post-1978 works (foreign and domestic) is not exactly limited times!
