In order to grant a pardon, you must have jurisdiction and authority.
Bush cannot be tried or impeached for war crimes or violations of the Geneva Conventions, Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and the International Covenant on Civil and Political Rights because he currently has functional immunity under international law.
When he (and the others) leave office (that's why even though Rumsfeld resigned as Secretary of Defense he still works in an official capacity at the Pentagon to retain functional immunity) they can be prosecuted.
Bush can be pardoned by Obama or McCain for crimes that violate US laws, but not for international laws, since a president has no such authority or jurisdiction.
Only the UN Security Council or other international body convened with competent authority and jurisdiction can pardon Bush & Co.
The US is not a party to the ICC, so it has no jurisdiction.
The World Court does not hear criminal cases and has no jurisdiction.
The ICJ has jurisdiction if the UN Security Council grants it authority. That would require Obama or McCain to order the US ambassador to the UN to either vote "yea" or abstain" and hope that the UK or France does not vote "nay."

Under international law, any country that is a party to one of the aforementioned treaties can try Bush & Co in their own courts. That means essentially that Bush & Co could never leave the US once they leave office for fear of being detained in tried in another country.
Thanks for the great info! That's interesting about them not being able to leave the US for fear of being detained - of course there are these rumors of Cheney (and Haliburton) or Bush or BOTH moving to Dubai. What do you make of that?

Just make sure Cheney, Rice and Rumsfeld are in the same court. Especially Rumsfeld. It would be time for him to face the harm he has been responsible for. Perhaps it would dawn a new day for integrity in politicians, if they realized they could end up on a rope for their actions.
I agree, especially Cheney. Hang him from the same gallows at the same time as Bush. I believe he is actually the mastermind behind the Bush administration and George W. is just the puppet.
^^^^now that's not very rational. a public hanging in the US? hey, if they hang bush, can the hang obama right afterwards for his crimes against humanity?
And what might those be? Bush's are obvious but Obama's?
Why not send him to one of his secret CIA prisons? He can be held without being charged or without access to legal council.
