It doesn't matter what the law concerns, what matters is that they are passed and are enforced just like every other law out there. It is not our place to decided how laws are enforced.

Leave it to the government and law enforcement to take care of this issue, it is their job after all.

Perhaps I'm not being clear. You walk into a county clerk office and ask for a marriage license. The county clerk is now under a mandate to deny same-sex marriage licenses. How is the clerk supposed to enforce the law without first determining the sex of the applicants?

And before doing that, one would have to define gender itself as either being based on the phenotype or the DNA, because they aren't always the same. People with XY chromosomes are sometimes born with vaginas and develop breasts, for example. It's called androgen insensitivity syndrome, and that's just one example.

My question is a valid one. Laws have to be enforced, don't they? You can't enforce this law without either inspecting someone's genitals or demanding a DNA test.
