I don't remember reading anything about the child being physically injured. If he was physically injured, then yes, I believe the penalty should be more harsh.

ANY assault on a child is "violent". There does not have to be any physical injury to prove otherwise.

I don't think that vigilante justice is something the courts and legal system should encourage or facilitate.

Hence why they are segregated.

My understanding of the law is that there is a difference between a violent assault and a non-violent assault, even if it involves a child. I'm sure the laws vary from state to state.

There's a difference between a sexual assault and a regular assault. A sexual assault is generally punished more severely, even if the regular assault causes physical injury and the sexual assault does not.

A violent sexual assault (one causing serious physical injury) is punished more severely generally than a sexual assault that does not cause serious physical injury. That said, they ALL cause severe emotional injury.

I thought the discussion we were having was about your desire to put this guy in prison with the general population.

Yes - the laws vary

Regardless though - this defendant, if proved guilty, faces decades behind bars (which is not long enough IMO) - and will, if released, have to register as a Tier 3 sex offender - for the rest of his life. He may also be required to wear a monitoring bracelet.

Yes - that is what I would like to do - personally.

But, professionally, I have to request segregation.
