For the past three years my husband and I have been fighting my mother, to protect my son. In May of 08' I signed a stipulation at the advice of my lawyer. This stipulation was that she got visitation rights of my son 50 days a year.Not knowing the affects this stipulation would have on me or my family. I only signed it becuase my lawyer told me if I did not, I would go to jail. During the time that my mother has had her visitation. I complied with the visitations up until my son would come home and tell me that abuse was going on when he was with her. So then I stopped taking him. Plus, I didn't have the money to pay for my flight every month of twice a month just to fly him to phoenix. When I signed the stipulaiton, I was living in California. So I assumed the California courts could take jurisdiction after 6 months, which is what they should do under the UCCJEA. It turned out that California had a trial to determine this and the judge decided not to take Jurisdiction. Leaving my son at risk of more abuse and physcological damage. Recently, a civil warrant for my arrest is in Arizona, but they don't want to extradict, so my mother's attorney wants the California courts to issue their own warrant for my arrest for not allowing a woman who did not raise because she was abusive to me, (and admitted so in court!) She forfeited her parental rights of me. to see my son. Except, I have obeyed the California courts and have broken no law. I tried to get my son on the plane for his visitation, but he wouldn't come out of the car. I was told to first talk to him to get him to go, then if he won't physically force him, do whatever it takes to get him to his court-ordered visitation, including hold him, drag him, you get the picture!! So since I did not do this, I am as the judge puts it, " paying the consequences for my son's trantrum". THe judge has refused to look at the evidence pertaining to attempting to take my son and is not following the law. I have a week with my three children (5 years old, 24 months old, and 5 months old) as the judge put it and said, "you need to be prepared that at the next hearing you will be taken into custody." This is grandparent visitation, not another parent! And California does not recognize grandparent visitation anyways.

While many states offer certain rights to grandparents, I'm not sure how these would fit into someone removed from their mother for abuse, and especially if abuse of the grandson is documented.
