Obviously in an American court he is presumed innocent. Just because Obama said he'll get the death penalty doesn't mean a fair trial isn't in order. Mayors and governors have said certain suspects on trial will get the death penalty, doesn't mean they didn't get a fair trial.

The guy should be proven guilty as he likely is and will be given the death penalty. It will go through a fair legal process too. One thing won't change though: conservatives will find a way to whine about it. "Somehow this is helping Al Queda"

And if during this fair legal process, the case is dismissed, or he's found not guilty? What happens then?

Well, Obama and Holder have said that he would be held in detention anyway, indefinitely. So explain to me how this trial is not a farce?

We have a verdict already decided by the Attorney General and the President (good luck selecting a non-biased jury), and a back up plan that flies in the face of the criminal justice system.

Maybe that's what conservatives are "whining" about.

But, but, but we are nation of law and due process, how can this happen?

Being a former lawyer, Obama just handed them a mis-trial.

What a total fool he is.

This trial is NOT about KSM, it is about going after Bush, CIA etc and allowing the enemy to obtain vital security information through these trials.

Never believe for a minute this is about KSM and the others. It is not.
I'm not a lawyer but interested in law and with my knowledge which compared to you and other lawyers might be zero....I knew this is legal trouble if the president and Holder start to say "they will be convicted" and the jury will do their duty....than you know there is trouble .....

Because we have people in charge that feel they can change the rules.
We have no one to stop them either.

But you guys are the ones who essentially wanted him hung in public without a trial? Why are you complaining?

He's admitted his guilt. I'd be perfectly happy to see him hung without trial.

The better question is-why are you supporting this farce?

I don't support nor not support it. I just find it hypocritical of those who were whining about this guy getting due process now they act like politically correct law professors.
