Personally I think this is a travesty. They had days of warning to get out, they refused. I ask again, what happened to personal responsibility. They took their lives in their hands when they decided not to get out after warned.

"A basic tenant of emergency planning is to do just that, plan for an emergency. How do you evacuate people who are immobile, who don't own cars, who are in hosptials. The govt. failed.

To be clear, the state and city govt. failed them. Local and State have the first response responsiibility. "FEMA's primary responsibilities are to determine the amount of funding, participate in educating the applicant on specific program issues and procedures, assist the applicant with the development of projects, and review the projects for compliance."

yeah all the old seniors in the rest homes and disabled people who live alone really were able to get up and get out of there. these macho old folks figured why leave they could handle a small storm like katrina. so many of you guys think everyone is in your situation, has your resources. news flash they don't.

So if they don't your standing is they can sue the government because they don't have the same resources?? Unreal. I guess if some old person gets whacked by a tornado they should sue uncle sam for not moving em too right??

don't twist my words to your thinking. this has nothing to do with their resources. they have the right to sue because the ARMY CORP did not do their job. that is the fact, the levee broke and AC knew all along it would happen. that is why they get to sue. your post, supported by others, that the people that didn't get out after they were warned could have or wanted to stay, is BS. this false attitude is a great example of judgmental thinking at it's finest.

I think they should sue the state. Let them bankrupt LA. Now, I realize this law suit is unlikely to be successful, but if it were, the nation would be in worse condition than it already is. Also, as taxpayers we would all be responsible even tho many of us are hundreds of miles away from the south. I feel bad for these folk, but not bad enough to pick up another tab.

Just to clarify, are you stating that all those who stayed in NOLA had no choice but to ride out the storm in the city because they had no means to leave town?

Most that died were over 50 and ~30% were >75 yrs old. It's not unreasonable to figure that appropriate decision making could have been compromised.

I too think the suits will never get anywhere just because of the appeals process we have in the us.
