that's an interesting little diversion.

If I understand correctly, Congress has to approve the EPA's budget. I'll be curious to see how Congress reacts to Obama's and the EPA's intent to circumvent their failure to pass cap and trade.

i say good for the EPA.
What is good for them? That they created policy to which they will have the power to enforce regulation, fees, and fines based on a topic to which the science is solely supported and currently under severe scrutiny for misconduct?

BTW... The EPA bases its findings solely on that of the IPCC to which the IPCC's findings are based strongly on that of the CRU's data and research, as well as those implicated in this scandal.

The legislative branch exists for the vary purpose of arguing over the validity of these types of powers and you think it good that an administration can bypass this check and balance to enforce its opinion?

Please explain why this is "good" in how it relates to this very issue?

If 300 million people agreed to hold our breath for a minute each day, would it make enough of a diffrence that the EPA wouldn't have to "command and control" the economy?

As already stated Congress can amend the act, the Supreme Court Ruling deals with the current Act.

Actually there is amendment in the pipeline and the Energy bill also excludes them from oversight from my understanding.

H.R. 391: To amend the Clean Air Act to provide that greenhouse gases are not subject to the Act, and for... (GovTrack.us)
1/9/2009--Introduced.
Amends the Clean Air Act to: (1) exclude from the definition of the term "air pollutant" carbon dioxide, water vapor, methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, or sulfur hexafluoride; and (2) declare that nothing in the Act shall be treated as authorizing or requiring the regulation of climate change or global warming.

And the last election was VERY one-sided. I'll go out on a limb and guess that the majority opinion of those elected would be to keep it open. And regardless what today's public opinion poll may show, over the longer term, most Americans would probably agree that the EPA does more good than harm.
