The feds couldn't present any evidence showing they committed any crimes, so far...unless they manufacture "evidence" the feds will lose the case.

That prediction is premature we will see how the case turns out. The appeals court felt their was enough infomation to keep them locked up without bail. The number of right wing militias has tripled in the last few years and is certainly a concern.
