Let me tell ya i know a lot about the Malfunction clause, my Son use to work at one of the very large Casinos, think they like it when a high jackpot is won, ask again, wrong no they do not. It is all about the Casino. I feel that she should win the highest amount the penny machine offers and no more. If it truly was a manfunction no she should not win the 42 million, and being a penny machine, it was probably a manfunction. My Son use to tell me all sorts of stories that the Casino's pull and they know it. The Casino's are all about how much of YOUR MONEY they can get you to spend.

Anybody with half a brain understands that and stays out of them. It's kind of like the lottery, another tax on those with limited IQs.

Give me a freaking break, then i guess there are many that don't have any brains, because do you know the people who spent half their lifes in those places, please my Son worked for one for 5 years, i can tell you plenty of stories, don't think you know the brains of all America cause you do not. There are dumb people who blow their checks at the casinos, then cry, on the way home.

I would say it depends. Obviously it is difficult to asses it not paying out if the machine malfunctions, yet still appears functional, but I would want to see what their policy is when it is obvious in such a case.

If for instance, I put money in their machine and it stopped between a symbol, would they give my money back? If they wouldn't, then I would be all for her throwing their own rhetoric back at them. Yet, if their policy is to refund on those cases, then it would be fair for them to also refuse a payout with such.

Whatever the top prize was or whatever the top winnable prize for what she had played. Indian casinos can get away with this, they can't be sued for refusing to pay out jackpots.

Absolutely she should be paid.

If the casino needs to go back and sue the manufacturer of the slot machine for losses, then so be it. That however has nothing to do with the winner.

hard one, something similar happened in NM about 3 or 4 years ago. As much as I would be really pissed, if the max payoff is $251,000 I would think that is what she is entitled to..A free breakfast and $23 rediculous, if it malfuncioned so what: couldn't they claim that everytime a jackpot is hit?

And then they should be fined for the insult of offering her $23 in lieu of the jackpot money... they could have at least offered the supposed top payout!

That is about the most narrow minded comment I have read in a long time. Yes, we all know how it works, like we know how the lottery works, but to generalize and insenuate, those who enjoy the casino or the lottery for that matter have limited IQs is just plain out of touch. Many people, with high IQs enjoy a little gambling, it is a form of entertainment like a football game, a good book, a movie or going out to dinner. As long as those gambling realize it is just entertainment and filled with some excitement it is fine..
