Whoever Obama appoints..you can be certain of one thing..he will appoint someone who will strike down any challenge to the Health Care Takeover..even if it is a far right Bush / Cheney believer that the Executive Branch should be one step away from a dictatorship. Even at the risk of shifting the political leanings of the Court further to the right. Obama will survive or perish based on the Constitutional challenge that will come before the Court. If he loses..he is finished..pure and simple.

I do not believe he is worried about the legal challenges to the Healthcare Overhaul. At least not enough so to make that the upfront criteria when appointing a SC Justice.

Nonsense. The Court strikes down campaign finance reform and then overturns healthcare, I can't think of a better rallying point for the Democrats.
