Pa. judge tosses burned-by-price-scanner suit.

ERIE, Pa. (AP) - An Erie County judge has thrown out a lawsuit filed by the guardian of a 12-year-old girl who claimed the girl was burned and traumatized when a convenience store clerk allegedly aimed a hand-held price scanner at her face. Judge Ernest DeSantis Jr. ruled in favor of the Country Fair store in Erie, after its attorney argued that the plaintiff failed to make a case on Wednesday.

And yet we're told that tort reform is "unecessary".

And yes, I know the case was tossed. If it wasn't dismissed with prejudice then the attorney can go judge shopping.

The only way she could have suffered from having the scanner pointed at her face is if it generated a seizure from the flashing light in her eyes and she was injured from the seizure which can be very painful. These scanners do not burn.
