As the government releases emails from the GS case!

I'll wait for their "silly prank" defense as well..

Blowing the whistle on a government agency is a lot different then hacking the email account of a person.
Sarah Palin was the governor of Alaska and a candidate for the office of Vice President of the United States at the time, and what was posted was evidence that she was illegally and unethically using her personal email account to conduct state business. Sounds a lot like whistle-blowing to me.

If someone "inside" uploaded them, its still hacked, unless you are claiming they were all forwarded by Palin..

Its not illegal, nor unethical to use personal email accounts to conduct state business. Where do you get this from?

The mere fact he tried to gain access to it is a crime, if he had access to it because Palin gave it to him then you could use the whistle blower defense.

From the news articles from the period when this happened, such as the quote below.

Sarah Palin's E-Mail Hacked - TIME

If it is not factually correct that it is not legal then I apologize, but to the best of my knowledge it is. It is certainly unethical when the reason for it is to sidestep the Freedom of Information Act and Alaska's disclosure laws.

Sarah Palin gave everyone in the world easy access to that account. Her password reset question/answer was something anyone with an internet connection could have looked up. The extremely low security levels of a webmail account is a very good reason why elected officials should not be using them for official business.

If I leave a window unlocked, it's still illegal to break into my home.

I applaud your unbiased and non-partisan logical review of this situation KevK.

I agree.

True. However, if I break into your house and find you have a bunch of slaves chained up in your basement and report you to the world, what you have done is no less illegal, and what I have done seems but a trifle in comparison, no?

The horrific nature of my crime would subject me to a long term in prison, yet you might be in the cell next to me for a while.
