Bascailly most of that article is flat non-sense as to theft. Yes she can be charged but the laws give police and proesecutors wide discresion on purpose.Its the reason for this as well as for the right to jury trial. That goes directly to the idea of intent in very law. Just as murder can maen different thigns depending on the intent.There is no conflcit with ehtics but it will be looked into as to intent and even the poice can and do stop such prosecutions all the time. Why becuase the police are the eye and investigators of circumstances for the courts, Prosecutors give their opinon much importance;as do the courts.
This makes me think of something my American government & law teacher told our class a while back: "If somebody breaks into your house, and you shoot & kill them, you better dump the body off somewhere and not tell a soul. You technically just committed manslaughter."
That's ridiculous- they're breaking into YOUR house and trying to steal YOUR stuff. Nobody's going to miss them; they're a common thief who gave nothing to society. But still, you shot and killed somebody without them harming you first, so therefore you broke the law.
It's similar to charging that one girl who was sexting a while back, got caught by her teacher, and so was forced to register as a sex offender. Though her conviction was later over-turned, what good would having a 16 year old girl on a sex offender registry do for society? Ruin her life and chance at a future? God forbid kids make mistakes because nobody who is an adult ever did something they shouldn't have, ever.
