"The arbitrator ... made a factual finding that the school committee failed to meet its burden of establishing that Robishaw could not speak English fluently," Justice Margot Botsford wrote for the court in the unanimous ruling. "We are bound by this determination."
First, therefore, we need to establish whether she can or cannot speak English.
"Fluency" with first graders? And? Wouldn't it be nice to have people who are fluent in English teaching first graders?
I doubt if you can find many teachers in the South who don't constantly use the word "axe" every time they ask a student to ask for permission to use the restroom.

I had a chinese professor teaching chemistry with an accent so horrible no one understood a word. I don't get why they'd hire anyone who can't speak properly. Take voice coaching lessons please. A teacher shouldn't be the one thing in the way of education.

It's a funny thing. Here we are, a couple of days after it was pointed out that the original post falsifies the true story, and neither the OP nor anyone else who is so outraged by what happened has been willing to correct the record or to respond to what the actual facts are.

They are just weeding out those who can't "pick it up" from the textbook.
I think the belief is, that if you can't pick it up on your own, you have already failed.
