Default Milage Rate

My employer is still paying me the old mileage rate 0.48 per mile, but I recently found out it went up in November to 0.55. Does my employer have to pay the new rate?

No, there is no actual requirement that they pay anything.

..additionally, you can deduct the difference between what your employer is paying you and the IRS rate when you file your taxes. You have to itemize and I believe the total unreimbursed employee expenses must total more than 2% of your AGI in order to benefit you.
