You know, things were simpler back in the old days...
If a woman has her fertilized egg implanted in someone else's womb, who is the mother of the child? The biological mother, or the woman who delivers the child?
It depends on the situation. If a Betsy has her egg implanted in Martha for Martha to carry the pregnancy and deliver the baby, then the baby is given to Betsy to raise, then Betsy is the mother.
If Betsy donates her egg to Martha, and Martha carries the baby and gives birth and takes the child home to raise as her own, then Martha is the mother.
If Martha is inseminated by Betsy's husband and gives birth to her own biological child and gives the child to Betsy to raise, then Betsy is the mother.
If Martha is inseminated by Betsy's husband and gives birth to her own biological child and raises the child, then Martha is the mother.
If Martha is a teenager and gets pregnant the old fashioned way and decides to give the baby up for adoption to Betsy, then Betsy is the mother.
It's about who raises the child, not who supplies the egg.

As an adoptive mom of 2 little girls from China, I cannot tell you how wonderful it is to see someone who actually "gets" this!
Thank you for this post and for acknowledging that it takes more to being a mother than giving birth.

In adoption, the "real parents" are those who raise the child, but the child will always be the bio mom's "baby".
An egg donor is not really involved in the same way a birthmom is, but we're not talking here about an egg donor here. This subject is surrogacy. In this case, the birthmom (surrogate) is acting as an incubator, so to speak. While she probably has feelings toward the child she is carrying, she does not share DNA.
Is surrogacy even legal? I was under the impression that it was not, but then again it's not something I've ever looked into.
There have already been legal issues over this very thing...the birth mother had NO biological attachment to the child--other than the whole pregnancy and delivery thing.

ITA.
In the case of surrogacy, I believe that there are generally contracts signed that would legally bind the parties involved to carry out the agreement. If they didn't have their ducks in a row with the contract, then my guess is the courts would probably side with the woman who carried the pregnancy, just guessing though.
