I believe the answer to that is "no". I think that legally it's an all or nothing deal. Either you live here or you don't, fairly straight forward.

Default It wasnt meant to benefit anyone who wasnt living and working or retired "here" full time.

Says who? The wording of the law says 6 months and 1 day. Why didn't it say 9/10/11 months if it was meant for full time. I think the state made the law to entice people to stay and spend longer then just a vacation home. You file federal taxes, do you use any deductions?

That is a question. If both names are on the deed, do both people need to claim the same residence as their primary?

My money'd be on yes, if both names are on the deed then both people need to prove residence.

So, if I want to remain a resident of my current state, and my husband wants to be a resident of Florida, we can't do that? Again, I'm not looking to apply for a Florida homestead exemption. What if I want to keep my DL and car registered in my home state since we still own a home here?

My apologies. I think I need to go back and take remedial reading 101.

I don't see why you couldn't remain a resident of your current state and your husband be a resident of Florida. Just no Homestead Exemption would be able to be claimed. At least that's my understanding of it. I'm no lawyer though.

Not trying to hex you or anything but legally separated, yet still married people move and live in different states everyday. The Exemption glitch comes into play if you're both on the Florida home deed/loan.
Again, I could be wrong, but that's how I understand it.

What if they get over by having the wife have her name on the Florida house and have a Florida driver license and the husband has his name on the other home and an out of state license? How do they catch them?

In that case they probably wouldn't but removing people from a deed isn't trivial. If there are mortgages involved, damn near impossible.

Why does everyone try and subvert the system/laws. That's part of the reason our society is so screwed up with lawyers, laws, etc...
