Default clayton homeowner association

i added a freestanding deck to my house recently. I sent the paperwork in to get it approved by my HOA and waited 30 days. after 30 days i had no response from them so i built the deck. 2 months went by and i received a letter stating that i have to tear my deck down. in our covenant it states that the HOA has 30 days to respond. seeing how they violated their end of the contract can they make me tear it down?

Can you prove you sent in the paperwork? I would contact a lawyer...but it does sound like you may have a case. It the deck somehow out of place for the area?

"Your house isn't cookie-cutter enough for this subdivision - tear that deck down. Our contract states that at least 10 other houses in this subdivision must look exactly like yours."

And people wonder why every suburb everywhere has an equal claim to being the most boring place in the US.

Now that isn't how they all work...most hoa boil down to power-trips of a few people.

That would be the mentality that takes a decent idea for property ownership accountablity (because no, not everyone has the basic concept of what living with neighbors involves) and makes it into a huge problem in some areas.

Not sure if the oil field problem is an hoa issue....I can see a wide variety of people not wanting that news to come out...at least until they sold their property. Not ethical...but I can easily see it happening.
