It is a center that will process prisoners on a daily basis in chains and under armed guards. Watch the video of the current location. Channel 5 I think. Based on the ICE website and info on the Town of Cary website they seem to primarily focus on sex offenders, child molesters, gang members, drug dealers, human traffickers and potential terrorists who happen to be illegal and other "family friendly folks" that you would want within walking distance of the three daycares, and elementary school and several hundred or maybe thousand occupied homes in that area.
As i understand it, Municipal governments generally have no power to enforce the retail only zoning with the federal government. The Town is going to need people writing and calling elected officials (not town of Cary - more like Senators and Congressmen) if they are to prevent this from going into such an inappropriate place.
As much as people like to Cary bash, I just can't see how anyone could justify why this would be a good location for this type of high risk law enforcement activity.

Folks it's quite simple. Whether they are allowed to do it is not in question. What IS in question is the awful awful choice of location for this facility. In a neighborhood shopping center! Seriously. There are plenty of areas to choose from, it's not like buildings for lease are scarce these days....move on to another location, preferably one not in the middle of soccer mom suburbia. Give me a break.

Interestingly, up till the latest update, that same link said that if the facility was owned by an entity other than govt and leased to them that they would have to fall under the zoning regs.
I don't even live very near there and have not been in that center since the eBay store closed and the new Dunkin Donuts opened on Davis so I really don't have much skin in the game but it's still total BS to locate it there. It's not about Cary avoiding "bearing the brunt" of the facility. They already have it and have for years. This location is just silly for an office of any kind.
I feel sorry for the property owner. I work in commercial construction and development. I've been on their side, but this use does not work on any level. I honestly can't see how it makes sense financially to subdivide such a large building that is such a disparate use into something the size they currently have or even to something a little bigger. Separating the utility services alone us going to be super expensive, then you have fire separation walls which going all the way up to the higher roof if a grocery store are not cheap either then totally start from scratch with new walls since it's all open. I just don't understand.

There is so much vacant space in Cary and Morrisville, how could this center even come into play?
I'm wondering if it isn't just a straw-man choice, with no real intent, while other locations are considered.
I for one am excited about the possibility of the ICE office relocating to this location. That space has been vacant for a long time and it will benefit local businesses and the community to have it used for something.

But, if they mess up the building by carving off 25% of it and do some weird entrance features while leaving the other 40000 sf +/- vacant, is that really a good thing? Thats the only scenario I can think of happening right now as there are about the same number of 40ksf tenants out there as need 59ksf. Unless they are planning on drastically increasing the size of the ICE office.
They are planning to combine several ICE facilities into one building. They are also planning to move the Evans Rd. facility into that building.
